Senior Care Locals, LLC, along with its affiliates (collectively referred to as “Senior Care Locals,” “we,” “us,” or “our”), is delighted to offer you access to this website and related online services (collectively, the “Site”). These Terms of Service, along with any additional policies or documents referenced herein, such as the Senior Care Locals Privacy Policy, outline the rules governing your use of the Site. By accessing the Site, creating an account, or selecting “I Agree” when prompted, you accept these Terms of Service. If you do not agree with these terms, please refrain from using the Site. Any capitalized terms not defined here are explained in our Privacy Policy, which details how we handle your personal data.

Important Notice: These Terms of Service include a mandatory arbitration clause, a waiver of your right to a jury trial, and a prohibition on class actions or representative proceedings for resolving disputes. Please see the “Dispute Resolution” section below for full details.

Who Can Use the Site

  • Reside in the United States, in an area where the Site is available.

The Site is intended for users in the United States only. We do not guarantee that the Site or its content is suitable or lawful outside the U.S. If you access it from abroad, you do so at your own risk and must comply with local laws.

  • Use automated tools (e.g., bots or spiders) to access or copy Site content without our permission;
  • Manually copy or monitor Site content for unauthorized purposes without our written consent;
  • Introduce malicious software (e.g., viruses, Trojan horses) or interfere with the Site’s functionality;
  • Attempt unauthorized access to the Site, its servers, or related systems;
  • Launch denial-of-service or similar attacks on the Site;
  • Otherwise disrupt the Site’s normal operation.

Your Contributions

The Site may include interactive features like forums, message boards, or profiles (collectively, “Interactive Features”), where you can post content or materials (“User Content”). All User Content must follow the Content Guidelines outlined below.

By posting User Content, you grant Senior Care Locals, our affiliates, and service providers—along with their respective licensees, successors, and assigns—a non-exclusive, royalty-free right to use, reproduce, adapt, display, distribute, and share that content for purposes related to operating and promoting the Site. Your User Content is considered non-confidential and non-proprietary.

You confirm that:

  • You own or have rights to your User Content and can grant the above license;
  • Your User Content complies with these Terms of Service.

You are solely responsible for your User Content, including its legality and accuracy. We are not liable for the content or accuracy of anything you or other users post.

Our Rights to Monitor and Act

We reserve the right to:

  • Remove or reject any User Content at our discretion, with or without reason;
  • Act on User Content we deem inappropriate, such as if it violates these Terms of Service, infringes rights, threatens safety, or poses liability;
  • Share your identity or details with third parties claiming your content violates their rights;
  • Pursue legal action, including notifying law enforcement, for illegal Site use;
  • Suspend or terminate your access to the Site for any reason, including violations of these terms.

We may cooperate with law enforcement or court orders requiring disclosure of user identities or information. You waive any claims against us arising from actions we take during or resulting from investigations by us or authorities.

We don’t pre-screen User Content and can’t guarantee immediate removal of objectionable material. We’re not liable for any actions or inactions related to user or third-party content or communications.

Content Guidelines

User Content and use of Interactive Features must comply with all applicable laws and these guidelines. User Content must not:

  • Be defamatory, obscene, abusive, harassing, violent, hateful, or otherwise objectionable;
  • Promote explicit material, violence, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
  • Infringe on intellectual property or other rights;
  • Violate privacy or publicity rights or create legal liability;
  • Deceive others or promote illegal acts;
  • Cause annoyance, distress, or alarm to others;
  • Misrepresent your identity or affiliation;
  • Involve unsolicited commercial activities (e.g., ads or contests);
  • Suggest endorsement by us or others if untrue.

If you believe User Content infringes your copyright, email us at contact@seniorcarelocals.com with details. We may terminate accounts of repeat infringers.

Ownership of Site Content

The Site and all its content (e.g., text, images, software, design) are owned or licensed by us, our affiliates, or third-party licensors and are protected by U.S. and international intellectual property laws. No ownership rights are transferred to you. Unauthorized use may violate these laws and these Terms of Service. Senior Care Locals’ names, logos, and related marks are our trademarks; you’re not granted any license to use them.

Third-Party Links

The Site may link to external websites for your convenience. We don’t endorse or control these sites, their content, or their privacy practices. Accessing them is at your own risk, and their terms and policies apply.

Data Accuracy

We strive to keep Site information accurate but don’t guarantee its completeness or correctness. Errors may occur. If you spot inaccuracies, contact us at contact@seniorcarelocals.com.

Security

We take reasonable steps to protect your data from misuse or unauthorized access, but no system is foolproof. We can’t guarantee absolute security or prevent interception of data transmitted online. You’re responsible for securing your devices and transmissions.

Communications

By providing your contact details (e.g., email, phone), you agree to receive operational and promotional messages from us, such as service updates or senior care offers. Message rates may apply. Opt out by following instructions in the messages (e.g., texting “STOP”). Non-commercial messages may continue after opting out of marketing. Allow 30 days for opt-out processing.

No Warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied (e.g., merchantability, fitness for a purpose). We don’t guarantee the Site will meet your needs, be uninterrupted, secure, or error-free, or that defects will be fixed. You use it at your own risk and are responsible for protecting your data and devices.

Indemnity

You agree to defend and hold harmless Senior Care Locals, its affiliates, and partners from claims, costs, or damages (including legal fees) arising from your Site use, violation of these terms, or infringement of others’ rights. We may control the defense of such claims.

Liability Limits

To the fullest extent allowed by law:

  • We’re not liable for indirect, punitive, or consequential damages (e.g., lost profits) from your Site use;
  • Direct damages are capped at fees you paid us in the prior 3 months, or $100 if no fees were paid.

These limits apply regardless of the claim type or cause, even if we’re negligent, unless prohibited by law.

Governing Law

These Terms of Service and your Site use are governed by Texas law, excluding its conflict-of-law rules, except for the Dispute Resolution section.

Changes and Termination

We may update these Terms of Service anytime, effective upon posting. Continued use means you accept the changes. We can suspend or end your access at our discretion without liability. Certain sections (e.g., disclaimers, liability limits) survive termination.

Dispute Resolution

Read Carefully: This section requires individual arbitration, waives jury trials, and prohibits class actions.

  • Arbitration Agreement: Disputes (e.g., claims about the Site or these terms) will be resolved via binding arbitration, not courts, except for small claims, employment issues, or intellectual property disputes seeking equitable relief.
  • No Class Actions: Claims must be individual; collective or class proceedings are not allowed.
  • Process: Before arbitration, notify us in writing at 2734 Sunrise Blvd., Ste. 306, Pearland, TX 77584 with details of the dispute. We’ll attempt resolution within 30 days. If unresolved, arbitration begins with a demand served directly (no third-party service). An arbitrator (mutually chosen or court-appointed) will decide the case in Brazoria County Texas.
  • Fees: The initiating party covers initial costs up to federal court filing fees; we’ll split additional costs for larger claims unless a claim is frivolous.
  • Law: The Federal Arbitration Act governs this section. Non-arbitrable disputes go to Texas courts.
  • Time Limit: Claims must be filed within 1 year unless law prohibits.
